I bought a flat with my ex-husband many years ago (beyond holding period), but only owned 50% last time. Recently, the court ordered his 50% to be transferred to me because of our divorce. I know this transfer's stamp duty is remitted, but now I want to sell the house. Must I pay stamp duty for selling to other people? And if I must, how much will it be? Stamp duty on the whole sale, or only on 50% that i just got? or no need to pay? because the house was bought very long ago. Thanks!

Hi,

The Seller's Stamp Duty is applicable for the 50% that you just received via the transfer, if the property is sold within 3 years of date of transfer. It will be a percentage of the market value or transacted sale price, whichever the higher.
