I am the landlord of a 3bedder condo in Tanjong Rhu and in early Feb 2022, I've signed a 2 years lease with my current tenants. I saw the data transactions that there's an increase of rental prices in my condo. Can I terminate the TA with my current tenants and find a new group of tenants who are willing to pay the market rate rental now? or is it illegal to do so?

Hi,

Nope you can’t as the TA had already been signed and stamp duty was paid.

If the situation is reversed, where rental is much lower than your current rental, do you think it is ok for your tenant to terminate the TA and find new apartment to stay with lower rental? If it is ok to do so, what is the purpose of having a contract signed in the first place? Unless this is a term and condition that has been pre-agreed between the landlord and tenant and is reflected in the the tenancy agreement, otherwise it is not possible to do so.

Dear Owner,
All TA's are legally binding. As such, unless you can talk to your tenants and re-negotiate the rental increase, whatever that is signed, is legally binding. This is why it is always important to engage a real estate professional to do all sorts of lease or sale transaction. Sometimes, it is simply not worth doing a legal transaction all by yourself when one is not well versed in this line of business.
