Just to check
Person A is a divorcee
Person B is a Annulment
Both took hdb loan for their pervious house.
Both only took hdb loan once.

If A n B gets married and would like to buy an HDB flat.

Will HDB loan consider as taking 2nd time loan?

Hi,

1) This is obviously yes.
2) The HDB will consider this as their 2nd HDB loan for sure, no matter how you look at it.
3) Be it, 1 applicant, for a loan or 2 applicants for a loan.
4) The HDB will exercise the right-size policy to request they use their last sales 50% cash proceeds to top up the down payment in order to reduce the loan amount.
5) You may try to appeal to the HDB over this right-size policy matter. The HDB will consider on a case-by-case basis.

Yes It will be considered as taking a second HDB loan. HDB allows a person to apply for a maximum of 2 HDB loans throughout his entire lifespan. For a second HDB loan, HDB will require each party to place an amount in excess of $25k of the cash proceeds or half of the cash proceeds from previous sales whichever is higher as a deposit for the next house. Do note for divorce/annulment cases, only the cash proceeds that is apportioned to the individual seller as per court order from the sales of previous house will be considered. I have experienced 2nd timers not needing to place compulsory cash deposits as required by HDB as their cash proceeds from the sales of previous house is $25k or lesser (eg. A cash proceeds from sales of previous house is $25k and B sales proceed from sales of previous house is $25k, no compulsory cash deposits for next housing is required) I have even assisted some buyers in successfully appealing to HDB to waive off the compulsory cash deposit requirement with valid reasons.
