There will be a bit of inconvenience, but to legally claim back the deposit, you may need to file a small claim against the landlord in this case. And do inform the landlord that you will be doing so. Many landlords feel that tenants will not go to such extreme to claim back the deposit thus they will do it again and again to tenants exiting the lease, so they should learn their lesson if the tenant has returned a unit that is in good and acceptable conditions to the landlord at the expiry of lease.
