Hi, regarding the possession of unit, when you purchase the unit under the agreement, is there a vacant possession clause? If there isn't any, it might be your responsibilities. As for the damaged window you should check with the previous owner, which will let you know.

If you are currently or planning to find a property agent, I can assist.

If you are purchasing over a unit with tenancy, then there should be an inventory list for verification. If inventory list indicated that these furnishings are included in the tenancy, then it will not be the responsibilities of the tenant to clear these furnishings. For damages claim, you may wish to have them produce evidence to indicate that the window was already damaged when they first moved in as they will need to provide a copy of these defects to the landlord within 1 month of moving in as a form of record to protect their interest.

In the absence of such records, it will be their words against yours and will likely only be able to resolve in the Small Claims Court. If you have any agent, you should check with your agent who have helped you with this purchase.

I understand you're facing challenges with your newly purchased tenanted unit in Singapore. Here's a breakdown of the issues and some advice:

Issue 1: Leftover Furniture

Tenant's Responsibility: Generally, tenants are responsible for keeping the rental unit clean and tidy. This doesn't necessarily include removing furniture that doesn't belong to them.

Verification and Communication:

Check your Tenancy Agreement. It might specify responsibilities regarding leftover furniture.
Contact the previous owner and clarify if the furniture belongs to them.
Discuss the situation with the tenant. If the furniture truly belongs to the previous owner, they might be willing to remove it upon collection.
Resolving the Issue:

If the previous owner acknowledges ownership, negotiate a timeframe for them to remove the furniture.
If no agreement is reached, you might need to explore mediation or legal options (involving potential costs).
Issue 2: Damaged Window

Wear and Tear vs. Damage: Normal wear and tear is expected over time. However, damage exceeding wear and tear is the tenant's responsibility.

Evidence and Documentation:

Ideally, you should have conducted a joint inspection with the tenant before they moved in, documenting the condition of the window (with photos or videos).
If you don't have such documentation, it might be difficult to prove the damage pre-dated the tenancy.
Potential Solutions:

Try to negotiate a solution with the tenant to share the repair cost.
If the damage is significant and the tenant is unresponsive, refer to your Tenancy Agreement. It might outline procedures for repairs and deductions from the security deposit.
