For BTO flats still within the MOP, does HDB mandate that both husband and wife must reside in it? Or just one party will do? I intend to stay in it myself and rent the other rooms to tenants. Will this be an issue?

If we are informally separated, must we inform HDB?
We intend to wait out the MOP before divorcing so we dont need to surrender our flat to HDB - but is that all we can do? Or can we appeal to HDB to let us sell it on the resale market before 5 years?

Hi,

1) Yes, it is mandatory that all owners and core occupiers must be living in the flat during MOP.
2) As for your case, a married couple; regardless of whether it is both owner or 1 owner + 1 core occupier must be living in the BTO within MOP.
3) Yes, you are allowed to rent out room(s) during MOP. Minimum must keep 1 room to yourself, it can be a common or master room.
4) You may submit an appeal to HDB to allow to sell in open market before MOP. It is up to the HDB discretion for approval. All approval is on a case-by-case basis.
5) The HDB only recognised legal process/action, thus, voluntary action need not inform them.

Hi

All registered Owners and Occupiers have to be occupying the flat during the MOP period. The spare rooms can be rented out while you guys are staying there. Is your MOP of 5 years about to be fulfilled soon?

Appeal is on a case by case review basis, it is not automatically granted. Perhaps you can share more info over phone so I can advise better. I have helped a few divorce case sellers with their house sale, and can share some inputs.

Hi,

For BTO flats within the Minimum Occupation Period (MOP), the Housing & Development Board (HDB) requires owners to stay in the flat as their main residence. Renting out rooms is allowed, but the whole flat cannot be rented out before the 5-year MOP is completed.

If there is a separation or change in marital status, it is advisable to inform HDB. Selling the flat before MOP is generally not allowed unless approved by HDB under special circumstances.

Here’s how HDB rules generally work for BTO flats under the MOP:
1. Occupancy requirement: HDB requires that at least one of the flat owners must occupy the flat as their main residence during the Minimum Occupation Period (MOP), which is usually 5 years. It doesn’t require both husband and wife to live there, so you can legally stay in the flat yourself.
2. Renting rooms: Renting out rooms in a BTO flat during the MOP is not allowed. HDB only allows renting out the entire flat after the MOP. So letting tenants stay in other rooms would be a violation of HDB rules.
3. Informal separation: HDB doesn’t automatically require notification for informal separation. However, if your marital status changes (e.g., divorce), HDB rules affect ownership and eligibility, so you must inform them when legally divorced or if there’s a change in ownership.
4. Selling before MOP: Selling a flat before the MOP is generally not allowed, except under exceptional circumstances like HDB’s Hardship Appeal (e.g., medical or financial hardship). Simply wanting to sell before divorce isn’t usually sufficient to get approval.

So in your plan:
• You can stay in the flat yourself.
• You cannot rent out rooms during the MOP.
• Waiting out the MOP before divorcing is a common approach to keep the flat.
• Appeals to sell early are very limited and need strong justification; HDB rarely approves sales before 5 years for personal reasons.
