Currently I am renting my room to a tenant.Provided that we the landlords have do ours responsibility to provide all requirements stated in the tenancy agreement and we have done nothing offensive or breeching any condition stated in the TA. But if he insisted to terminate the tenancy before the 12 months agreement and also even lesser than 6 months just because that he wanted to shift to stay together with his friend which accommodation is nearer to his workplace, as a landlord I suggested that he should find a suitable replacement tenant to sign the contract before he leaves.But what if he couldn't find a suitable tenant and just left the tenancy with 1 month deposit compensation to the landlord, can I still request that he should cover up all the costs of rental until the landlord found a suitable new tenant by using lawsuit(because in the TA I only stated that for premature termination of rental, tenants only have to find a suitable replacement new tenant to get back all the deposit upon leaving or to forfeit the deposit if they didn't find a replacement tenant).
But now for this case, we felt that we are played by the tenants.We didn't do any offensive to the tenants or reverse to the TA. If the tenants can just shift in anytime or shift out whenever they like, then what is the purpose for setting up the homestay TA? They should just stay in the hostel/hotel.
Even if we forfeited 1 month deposit, we still have to bear a loss. Time and effort are needed to post the listing and answer enquiries, it is very stressful for busy working landlords. When the suitable tenant still not found within a month, we have to lose an income for the second or even third month.
It is very difficult for us to find a suitable tenant within a month which is covered by the forfeited deposit(as we don't rent to Indian.We only rent to employees S pass and above, or employees working in the healthcare sector who know how to minimise the risk of covid,we require tenants to wear a mask in the common areas because we are staying together with high risk elderly.We allowed non oily light cooking of vegetables,meat and rice) .
Hence, can we the landlords, to request a lawsuit from the small claims tribunal to edict the tenant to pay for the remaining months within the rental contract that he supposed to fulfill but failed to do so , until we have found a new tenant for replacement?Given that he didn't find a suitable new tenant and left?
