We (owner) have recently renew our condo for another 1 year of tenancy. Due to unforseen circumstances, we need to relocate back to Singapore and will need to terminate the lease prematurely so that we get a place to stay upon return.

What is the best practice in this case? Is it mainly a mutual agreement between landlord and tenant on the notice period to vacate?

Yes, the usual arrangement will be a mutual agreement between landlord and tenant in this case. I will usually advise landlord to accept a lease replacement where the tenant is expected to look for a replacement tenant.

Apologies, I read the situation wrongly in this instance. You may wish to work together with the tenant to come to mutual agreement on premature termination, as a typical tenancy agreement does not allow the landlord to terminate lease as such.

Typically I will advise landlord for this apartment to look for short term rental over this period of time where the apartment is occupied.

Hi Suet Ting, yes it is a mutual agreement between both landlord and tenant. And in some cases, landlord would just suggest to pay a compensation amount to the tenant for breaking of tenancy agreement.

Good morning,

It would be ideal that the landlord work things out with the tenant and provide them with possible terms to make it a win-win situation. Compensation and providing adequate assistance on the shift will be helpful.
