My ex and I had bought a HDB and collected the keys in 2016 under the scheme of Fiancé and fiancée.

However, 7 years have passed. We didn’t manage to get married due to many unhappiness between the 2 families.

During that few years, we have requested to extend our submission of marriage certificate. Then, the pandemic falls in 2020. That’s was when both my ex and I felt that we couldn’t make it to the marriage. We finally give up and broke up.

Meanwhile, I have been staying in the flat till now. My ex and I have discussed about the house and he agreed to let me takeover the ownership of it since I have no place to stay.

(By the way, I am a Singapore PR when I applied for the flat, now I am a Singaporean nearly into my 40s)

Now, the house have reached it MOP and it can be resale flat. I was still being asked to surrender the flat where I have no place to stay.

I would like to seek advice on what will happen if I surrender the flat. What is the compensation calculation and how long do I need to move out? Is there anything I need to take note of. I’m feeling very stressed out now.

Appreciate advice on this.

I am sorry to hear about your situation. From my recent experience with a somewhat similar case as yours, HDB will ask you to surrender the flat and you will not be allowed to sell the flat in the open market.

You might wish to consult your MP to try appeal, but honestly I think the chances is very low. My other client failed in his appeal even after multiple visits to the MP and appeal emails to the Minister of National Development.
