Sorry to hear about your situation. Do write in to HDB to appeal if you wish to own under single SC scheme. If your son is under your legal custody, care and concern, you can continue to hold under public scheme.

Do double confirm with HDB on this.

Good morning,

Sorry to hear about the situation. You would have to write in to appeal to HDB branch on whether you are eligible to keep the flat upon divorce. It may help with the appeal if the child is placed in your legal care and custody. Otherwise, if the appeal fails, you may need to sell off the flat in the open market.

Hi,

1) Single SC (divorced/widowed) below 35 yrs old must have the legal custody of child/ren to be eligible to own an HDB flat.
2) The whole divorce process could take as long as 9 months before you receive the final court order. This is assuming it is a smooth separation without much dispute between the couple.
3) It will take about 3 months from your signing of the divorce paper to receive an interim court order.
4) I would suggest you check with your lawyer on the timeline of the whole process to see whether you will reach 35 yrs old by the time you receive the final court order.
5) Do remind you that most interim/final court orders will not have any timeline to divide your asset. Thus you may submit your appeal to the HDB after you reach 35 yrs old if the child's legal custody is with your wife.
