Hi, I own a private property and if I would like to purchase another private property (project under construction) can I get the 2nd property without paying ABSD if I want to sell the 1st property before the key collection of the 2nd property?

Hi,

Assuming this is not a matrimonial property held under joint name basis, to avoid ABSD you have to dispose off the ownership first before you exercise the S&P for the under construction property, otherwise ABSD is applicable.

As per your plans , ABSD is payable upfront but your family can claim back the ABSD ( few conditions to fulfill especially about matrimonial home , must buy in 2names as family ).

Alternatively , to avoid ABSD , your family can sell your present condo first ( sell with tenancy ) , and rent your present home from your condo buyer until your new condo is ready.

I am assuming that you have no intentions to hold on to the existing property once your new place is ready, based on the structuring of your question therefore decoupling is unlikely on the cards for consideration.

You could perhaps look into selling your existing unit with a rent back clause from the purchaser or opt to rent another unit after sale to resolve the concern of having to pay ABSD upfront for the purchase and then claim it back after sale. Take note that for claiming of ABSD, both the new property purchased and the old property sold should be in the name of both husband and wife.

Dear Sir/Mdm,

Unfortunately, the only way to avoid paying the Additional Buyer Stamp Duty is to secure a buyer and have the buyer exercise the option to purchase first before exercising the purchase of the new property.

Even if it is a matrimonial home, you will still have to pay the ABSD first and subsequently apply for a refund if you are able to sell off the property within 6 months from the TOP of the new property.
