Hi all expert, I am msian and holding PR for 10 years . And my partner just bought single scheme HDB about 2 years ago . Is there anyway she can sell it before MOP so we can get a resale hdb or apply for BTO?

And second question , understand msian can’t own any oversea property if buying Singapore hdb . So is there any way or criteria if my parent transfer their msia property under my name , is it have to wait 5 year MOP in Singapore property then only can do so..,

Dear sir/mdm,

5 years MOP is the requirement therefore any plans to sell before the MOP has to be approved by HDB on a case by case basis. Seller's Stamp Duty can be also applicable if your partner is approved to sell by HDB within the 3 years of ownership.

For question 2, as a HDB owner or essential occupier, you are not allowed to hold onto any interest of other residential properties within the Minimum Occupation Period.

Hi,

Unfortunately no, the MOP of 5 years must be fulfilled first before you are eligible to apply for the next HDB. And once in the application as a owner or essential occupier, you are required to sell off all overseas and local private properties.

I would like to compliment Mr Ivan Ng for his professional work and effort.I sent my first post in Jan 2019 and Ivan replied promptly, so I have decided to contact Ivan for follow up. My EC was not ready for sale due to MOP (another 3 months from Jan) at that time and Ivan was able to give me advices on how to proceed from there. Initially we have decided to try to write to HDB for early sale but since it was only 3 months left, eventually we waited for another 3 months while we looked for our next property. Hi Sir,

Your partner has yet to meet the 5-year MOP, hence she will not be able to sell off her current flat unless she manages to get special approval from HDB to sell the flat.

If you have genuine needs to move to a bigger flat, she may wish to write in to HDB to appeal for early sale before MOP. Approval will be on a case-by-case basis.

Also, as long as you purchase another HDB flat, you will have to meet the MOP before being able to purchase (or being transferred) another property both locally and overseas.
