What will be the best option?
Currently me and my husband are contemplating divorce soon and he will be transferring the current house with outstanding loan 300k to me/ no cpf return to his CPF. But I have a plan of selling this house and buy a bigger flat. Should I sell the flat before divorce or after divorce. Thanks.

Good afternoon,

Sorry to hear about the situation, I hope you are managing well. Is the HDB still within the MOP period? If so, you will need the divorce court order to appeal for early sale within MOP period. And to put in legal writing that no CPF refund to his CPF OA after the sale, it needs to come specifically from the court order so to have legal effect. Otherwise for a typical normal sale, by regulation all CPF utilized + accrued interest by respective owners for the property will be refunded individually to their respective CPF OA. And to also keep the flat under your own name, you need to be eligible to keep the HDB by being 35 years and above as a divorcee.

Dear madam,

I do not think that you and your husband can unilaterally decide not to refund the CPF funds to his CPF account on your own unless it is decided by the court. And since you have not filed for divorce based on your description, we won't be addressing this issue. As to whether you should sell before or after the split, the question will likely be if the split is acrimonious. If both parties are agreeable with terms and conditions, then you can proceed to sell before the divorce, which in fact could be better since some buyers may question the reason for sale and knowing that sale is due to divorce may create a negative vibe which may affect the final selling price.

If both are agreeable to selling and the terms, you may actually engage a private lawyer for conveyancing of the sale to split the proceeds according to the agreed terms between the 2 of you. Hope the above helps!

Hi,

1) The plan of transferring his ownership to you without returning to his CPF is unlikely can be done.
2) The whole divorce process could take a long time unless under special cases.
3) 3 yrs separation is a minimum for a non-challenge case, and 4 yrs for a challenging case.
4) From the submission of the divorce till receiving the final court order will take around another 9 months.
5) So if your plan is to split your way now, I would suggest you sell the flat now rather than wait another 3~4 yrs later unless there is still a long way to your MOP.
