Hi,

It depends on the court order arrangements pertaining to the property. Selling within MOP period of 5 years also require special approval from hdb. And Seller's Stamp Duty is applicable since its 3rd year of holding period. It will be 8% of sale price. May I have more info and requirements about your plans so to make better recommendations? Dear Sir,

For divorce cases, you will be able to dispose off your HDB upon approval from HDB for the waiver. However, do note that you will be liable for the Seller's Stamp Duty as if it is sold before the 4 year mark.

Your CPF plus accrual interests will be refunded back to your CPF OA account after the sale of your flat. I have assisted my clients in similar situations before. Please feel free to contact me so that I can understand your situation better and provide you with further assistance!

(1) Single PR cannot hold on to the HDB flat, unless he/she holds the custody of child/ren.
(2) It takes about 9~12 months to receive court order on the percentage of distribution for each parties and other related matters.
(3) Selling within 4 years of purchase incurred "Seller Stamp Duty" (SSD);
1st yr: 16%
2nd yr: 12%
3rd yr: 8%
4th yr: 4%
(4) Upon selling, sales proceed shall distributed according to following priority:
(a) Remaining loans
(b) CPF OA account
(c) Cash if any upon deduction of stamp duty or others if applicable.
If the cash proceed is insufficient to pay IRAS, then seller has to pay with their own saving.

(5) Even though you have received court order, it is still necessary to get written consent from HDB before starts selling, since it is still within MOP.
