Is there a current practise of agents advertising the landlord's apartment for rent but will only be receiving commissions from the tenant ? Since now the agent can only represent one party. What if the previous agreement where the agent represented both parties is due for renewal. Who will the agent represent then ?

Hi,

As per current guideline, the salesperson (housing agent) can only represent one party. For renewal of TA done previously with one agent representing both sides, the agent must decide which side to represent. The agent then can sign as the witness for the side he is representing.

For the other side, you can get anyone above 21 yrs old and is agreeable to sign as the witness.

For your question of salesperson advertising landlord's apartment but collecting commission from tenant, it is unusual. Of course, if the salesperson is willing, it can be done but must be careful not to infringe on the dual representation rule.
