I am a landlord and have been renting out my units for the past 10 years. I did my own advertisement and all that needs to be done to rent out my unit. I notice the trendup of agent representing tenant comes to me and ask for commission. They claimed “tenant not paying commission to them”. Well that’s against the law. Agent CANNOT represent both parties (whether they pay you in kind or in $$. -). If tenant agent agreed to service for free, it’s entirely up to his prerogative.
It has been increasingly uptrend for such practices. Has agencies such as ERA, PropNex has no regulation to control their agents?

Hi Chua,

Firstly, I don’t think there is an increase of such an issue. I believe many agents like myself will also skip those landlord as long as they are not paying any commission, so no point wasting our time and effort as we are all working hard and trying to put food on the table just like you.

Hi Mr/Ms Chua,

I believe that as an owner putting up advertisements on your own, the responses from your advertisements should generate significantly more enquiries from agents than from tenants, and with a market shortage of supply on units available for rent, this is 1 reason why you are experiencing such uptrend on agents requesting for commission. In our trade, we term such listings as For Rent By Owners, and we will usually connect with such owners and check if they are willing to pay commission, and in most cases, owners will want to know if we have tenants on hand or not. If landlords are not willing to pay commission, then it will be more direct to state up front to the agents who call. Otherwise, if you are open to consider paying the agent if you are able to achieve a certain price, this can also be communicated to the agent. For such cases where commission is collected only from 1 client in the transaction, it is not considered dual representation.

Most landlords in Singapore are in such a fortunate position to be able to have spare properties that can be rented out and be earning decent rental income given the escalating real estate prices in Singapore be it from sale or rental, while tenants on the other hand are away from home and having to pay the high rental in Singapore, it is only natural that most of them are unable to pay commission so agents who are looking to do business can only check if landlords are willing to pay commission, as what Aaron has indicated, all they are looking for is to put food on the table. Not all agents are Millionaire producers, but majority of agents need to put in extra miles just to earn that amount to put food on the table for their families.

    Thanks. I am fortunate enough to have accumulated wealth of knowledge in big data analysis too and also contract negotiation too. Both of which comes in very handy in tenancy work. These are also parts of skill set which an agent should have. Sadly most agents I came across just moves with the flow of using historical data expertise and standard clauses as their expertise etc..
