Hi Fayna,

Are both of you agreeable to the sale and also the splits of proceeds? In typical divorce cases, there will be a court order determining the splits and then with this court order, you can appeal to HDB for the sale before meeting MOP.

Hi Fayna,

For divorce matters, one of the issues to resolve will be the treatment of the matrimonial property. If both parties are agreeable to the sale, they can apply for that as part of the divorce proceedings and if the court agrees, the sale will be stated as part of the court order after the final judgement.

With this court order, it will be easier to appeal to sell earlier. I have helped some clients to appeal successfully. Yes once the balance sale proceeds are in, you can use them to purchase the next property. If its a resale flat, you also need to fulfill hdb eligibility conditions.

By the way, I did a couple of divorce cases and would be happy to assist you along with the paperwork too. Firstly, once the final court judgement is out and usually it would be to sell the flat in the open market within 6 months, with cash proceeds to be split equally. Then next will be to write in to HDB with the court order and to ask for early approval to sell and most of the time HDB would grant the approval base on divorce ground.

Hi Fayna,

I will be happy to assist you in the appeal and get the waiver of the MOP. I have assisted many of my clients who are in the same divorce situation to get the approval and subsequently sell the flat in the open market.

The split of the sale proceeds will be stated in the court order and the money will be split according to what it is stated and yes you may use the funds to buy another resale flat.

Hi Fayna,

1) It was easy to get approval to sell in the open market before meeting MOP due to separation in the past.
2) However, it was noticed there are quite a number of cases that the HDB only allowed to surrender to them rather than to sell in the open market recently.
3) Therefore it is important that you clearly specified that the court will grant you permission to sell in the open market and split the proceeds between both of you.
4) This will increase your chance of getting approval when you submit an appeal to the HDB with clear final court order instructions.
5) You may use all funds from the sales proceeds after your division to buy another resale flat as long as you meet the eligibility criteria set by the HDB.
6) The HDB will not penalize you for the purchase due to this mishap.
