Would like to check if we purchased a private condo as 2nd Property which TOP 2020 as married couple PR-SC status, can the ABSD remission happens if we sell our 1st Property HDB Flat(first purchase of unit directly from HDB in Year 2007) in between 2017 to 2019?

I checked from the web search , it stated within 6months of TOP, so would like to have a confirmation on this that the ABSD remission of 10% can be obtained if the HDB unit sold in between 2017 and 2019.

Hi,

All ABSD remission need to done by law firm handle your purchase. Possibilities of the ABSD remission might be rejected as the one of the owner is not SC.

Some case, ABSD remission rejected due to lawyer issues too.

Hi,

The wording on IRAS website is quite clear, hence if you are planning to sell earlier than their requirements, its best to write in to get their approval for potential ABSD remission before selling your hdb. Nonetheless you can't avoid the ABSD if its a joint purchase of your 2nd property.

Based on current regulations, as long as you sell off HDB anytime from the date you pay the ABSD till you are required to sell off HDB within 6 months from TOP, you are eligible for ABSD remission.

The law firm you will be using for the purchase can assist you in the remission so not to worry about it. If you like to, you can speak to the sales manager of the law firm my clients always use for further clarification.
