Hi, I'm currently looking to rent a conddo with two friends.

We are all British expats on employment passes.

What is the best way to do the two year lease so that if anyone of us needs to leave the country after one year we can get out of the contract assuming we service notice. I know about diplomatic clause, but most landlords want only one tenant to sign the agreement. What would happen if one off the other tenants has to leave and therefore the other two can't afford the rent?

Dear Lawrence,

A tenancy agreement in most cases are considered private treaty where both parties need to agree on the terms and conditions before moving on. Perhaps what you may wish to explore is to include relevant clauses to ensure that your interest is not compromised in such circumstances. You may wish to explore clauses like seeking replacement tenant for the outgoing tenant? Do take note that diplomatic clauses in most tenancy agreement can only be exercised if the tenant is asked to leave this country by the employer or cancellation of the employment pass. It is not a case where you have the flexibility of serving notice period after 12 months to get out of the place.

Be careful of what are the terms and conditions you are putting signature on for it could have severe consequences.

Hi Martin,

I have a 3 bedroom unit for rent at Thomson Grove, near Yio Chu Kang MRT Station. If you are keen, I can work out the Tenancy Agreement to meet your requirement regarding early termination of lease due to cessation of employment. All 3 tenants will jointly sign the Agreement and Diplomatic Clause will kick in after a minimum of 12 months continuous rental - variations can be discussed as long as the landlord is agreeable to the terms.
