Hi, I recently ended my tenant's 2yr lease in my 3 bdroom condo 8 mths before the lease was up. I had receive complaints from neighbours that he had partitioned my living area to create 2 extra bedrooms. He had also turned the utility room into another bedroom. When I inspected the place, I found that there are other people living there besides the 6 approved tenants. I got them to remove the partions and told them to move out within a mth's time. They agreed to move out but refused to sign the early termination agreement that states the forfeit of their 1mth deposit for breaching the tenancy agreement by renovating my house without permission and subletting it. Till today they are hounding me to return their security deposit despite my explanation that they had breached the tenancy agreement. I had only asked for a 1 mth deposit instead of 2 mths which is the norm for a 2 yr lease. Thus the amount forfeited could barely cover my losses. The house was left in a bad state with many repairs needed after they removed the partitions. They wore their shoes into the house and did not maintain the house well. What can I do to get them to accept the forfeit? I only have pictures of the extra rooms they made and damages left behind. They have moved out but are atill expecting me to return their deposit.

Hi Sir/Mdm,

From what you have shared, there is clearly a breach of the tenancy agreement and therefore it is only rightful that the security deposit is forfeited. You can serve the tenant a notice to inform the tenant that besides the forfeiture of deposit, you will want to claim the costs of reinstatement of the unit and the loss in rental income.

Dear landlord,

This is definitely an unfortunate incident to happen for rental and I have also heard of many situations. Unfortunately, in order to enforce your rights as a landlord against the tenant, a formal legal notice is required and that means you will need to incur some costs to serve the tenant notice to forfeit the deposit. Since you mentioned that you have the pictures and damages left behind, I suggest you also bill the tenant on those repair costs and in the event that the deposit is insufficient to cover the costs, to also claim the tenant to top up. By the way, nope you do not have to entertain your ex tenant anymore and you definitely have the right to forfeit their deposit and also going to the small claim court as well if you prefer to.
