The law of contract states that there must be the following elements for a contract to be binding:

2. Offer (such as issuing of Tenancy Agreement to the tenant)
3. Acceptance (tenant has signed the Tenancy Agreement)
4. Consideration (Deposit as a promise to rent the room)

If all the above requirements are satisfied and you have signed the Tenancy Agreement, the contract is legally binding. Neither parties can retract without facing any legal consequences.

Since you did not sign a Tenancy Agreement, there is no contract. Therefore, the landlord must return your deposit.
