I currently own an EC with my wife and it has already past the 5 years MOP. I understand that I can decouple the property now and transfer sole ownership of the EC to my wife. In the event that I am freed up now, am I able to purchase a resale HDB or BTO?

HI

Buying a HDB flat, you must form a family nucleus. Both the owner and occupier must not own any private property locally or overseas.

However, you may buy a private property under single ownership.

Hi,

For HDB purchase, you will need to form a family nucleus (ie. Buy with your spouse name together) to be eligible. Hence for your scenario its not possible to buy on your sole name. You can however still purchase private property on your sole name no issue, and it may be a better choice for investment.

Dear sir,

I am afraid that the scenario will not be applicable as what my fellow professionals have indicated, under the Public Scheme, your wife will still be required to be the essential occupier for the resale HDB, thus she will be required to give up ownership to any private residential property too.

If you are planning to enhance your real estate portfolio, it will be good to discuss more about your plans from mid to long term in order to strategise a more optimised plan for your family.

Hi Sir,

If the next property that you are looking to buy is a HDB, then I am afraid it will not be possible if you still want to hold on to your EC. The reason is because when you buy a HDB flat, HDB will recognise you and your wife as one entity. So even if you are the owner, your wife will also need to be the essential occupier. For essential occupiers, they will need to fulfil the same 5 years Minimum Occupation Period (MOP) obligations together with the owner. Of course, 5 years later, the essential occupier will be able to purchase another private property without the need to pay Additional Buyer Stamp Duty (ABSD).

If you are ok, then maybe we can meet up for a discussion on this and we can see if we can churn out any suggestions or Property Wealth Plan for you. After we get to know more from you and your wife, we may be able to churn out some solutions for the both of you after looking at your figures. No worries on the meetup as there are no obligations at all. We can just take it as a chat.

Dear Sir,

Yes you are right. You may decouple the property after 5 years and free up your name. However, you may not be able to purchase a BTO or a resale HDB as you will need to include your wife as part of the purchase since you are a married couple considered under the same family nucleus.

However, the good news is that you will be able to get another private condo for investment or for own stay without the need of paying the Additional Buyer Stamp Duty.

Purchasing a HDB resale or BTO is not possible as your wife needs to be named as an occupier in the new HDB unit and HDB pocicy does not allow couples to hold to a HDB and private property at the same time. You may however consider purchasing a condo instead as it's more worth from an investment point of view. Trends since 2012 have shown that HDB flats do depreciate in value over time. Congratulations on meeting your MOP for your EC! This is surely a pot of gold!

Yes, you're right, you could "decouple" and take your name out of the EC. However, you're not eligible to apply for a BTO. You could go for a resale HDB though, but your wife will still need to sell off the EC latest within 6 months of your HDB purchase. She will not be allowed to keep the EC.

You could purchase a private residential property under your sole name without incurring ABSD, after you had "decoupled".

However, this may or may not be the most ideal plan for you and your family. I would like to understand more from you before I can give you a more appropriate recommendation.
