1) You can purchase another HDB flat after your divorce is finalised. You can sell your current HDB flat even before MOP is up if you have a permission granted by HDB. To submit the appeal, you can head down to the HDB branch office or do so online via the My HDBPage.

2) If your partner applied under the Single Singapore Citizen Scheme, she'll be recognised as the sole owner until you two get married or seek approval from HDB.

3) Once you're married or your special request is granted by HDB, you can add your CPF contributions.

4) It depends on the court order but usually, there will be sufficient time for you to market the flat properly and get a buyer.

5) It is possible to sell before the MOP date but you would have to appeal your case to HDB.

6) In the event of a failed appeal, you'll need to sell your HDB flat on the open market.

Good morning Alvin,

I replied your earlier post in regards to your questions 1 to 3.

The sale of your existing HDB will depends on what is agreed/ stated in your divorce papers (final judgement/ court order). If both of you agrees to put the existing sale up for sale immediate after its finalised, you can approach HDB branch office for special approval to sell within MOP. Usually it will be approved with valid reasons such as divorce.

Hi Alvin,

Let me try to assist you further.

1. As you are under the age of 35, if you are buying a resale flat, you will need to wait for the divorce to be finalised before buying another flat with your new partner.

2. If she purchase under the single scheme, the flat will be a sole ownership and if you wish to add in your name as one of the owners, you will need to seek approval from the HDB.

3. You will be able to use your CPF funds towards the flat provided that you are one of the owners of the flat.

4. It depends on the court order but usually there will be sufficient time for you to market the flat properly and get a buyer.

5. Yes in the case of a divorce, it is possible to appeal for a MOP wavier and sell the flat before the MOP date. I have assisted my clients who are in the same situation to appeal successfully before.

6. HDB usually do not take in flats and would prefer owners to sell in the open market.

Hi Alvin,

1) The conditions to buy a resale or apply for a BTO shall depend on the following factors:
(a) Final court order is released.
(b) Met the current flat MOP or sold off the current flat (still within MOP) under special approval.
You wouldn't be able to apply for an intent to buy while your current flat is still within MOP, likewise to apply for a BTO.

2) This is feasible since she is not married to you yet. She can purchase the flat under the Single Citizen Scheme if she has sufficient funds and a loan to cover the purchase.
You may be the joint owner or occupier later depending on your future plan and current financial situation. The only shortcoming of such practice is that you will incur more costs such as legal fees, stamp duty, etc.

3) You can only utilize your CPF if you became the joint owner of her flat.

4) The court will not specify the timeline to dispose of your flat unless it is specially requested.
It is the HDB that will give a grace period of 6 months to sell once your appeal went through.

5) There are cases where the couple still stays under the same roof to protect the interest of the children after the legal separation.
But once you submit an appeal the HDB will expect you to settle your flat within the grace period.

6) The appeal is likely to go through due to a life event such as your case. The HDB has no interest to take over your flat thus usually they only offer 20%~25% below the market value if you are not able to sell it off in the open market.
The most common situation of not being able to sell at a reasonable price in the open market is due to ethnic restrictions. This was why the HDB had come out with a policy to address this later.
