Hi gurus,
We are selling our 5 room flat,out MOP will be in April 2014.Is it possible to ask for valuation and buyer's option fees first before our MOP and then hand over right after the date of our MOP?I heard it will take 2 months from the 1st appointment to the 2nd appointment.We do not want to waste time as we are looking to buy an a new EC unit and want to avoid the ABSD.

Morning,

Under the HDB ruling, HDB owners are only allowed to sell their unit upon fulfilling MOP. Hence any OTP signed prior MOP will not be recognised. You will also be required to submit the HDB resale checklist before you are allowed to issue an option to your buyers. Valided valuation report must also be available upon submission of the case by buyer. Even if you have a buyer who is agreeable to your terms and pricing, your OTP for sales will not be recognised by law hence you are still not eligible for the purchase of EC either. Furthermore, new EC is to be purchased and registered with HDB. I believe you would not want to break the law and tell the law enforcer that you have broken the law, right?
