Hi,

1) You are currently married thus you and your spouse are considered as a single entity in the eye of the HDB.
2) When you claimed ownership to an HDB flat, your spouse must be an essential occupier if not the owner.
3) You are already aware that an owner and essential occupiers of an HDB flat are not allowed to keep any private property after taking over the title of an HDB flat.
4) The other concern brought up from your info was the HDB flat had way past its MOP. But note that MOP is applicable to the owner and not the flat itself.
5) Therefore once you take over the title of the HDB flat, you are to observe the MOP as well as your spouse.
6) Therefore your idea of keeping the HDB flat while your spouse owns the private property is not workable.
7) If there is no other beneficiary for the HDB flat, you are to dispose of it within 6 months upon receiving the court order.

Hope the above answer your main concerns, but if there are more query, please feel free to contact me at 90110636  , or email: ling.ck7@gmail.com if more information is needed.
I'll be glad to assist.

Hi,

I would be most glad to assist you further and please feel free to let me know if you need any assistance. Have a good day ahead. By the way, in your case HDB would likely ask you to sell the HDB flat in the open market.

Hi Mdm,

With the inheritance, as this is a subsidized flat, you will have to sell either the inherited HDB flat, or your current condo. You will not be able to keep both properties. You do however have a choice on which property to keep.

I am experienced and well-versed in both HDB and private transactions. I will be able to assist you in your property plans. Please get in touch with me for a more in-depth discussion.

Should you need require further assistance in matters relating to property, please contact me at my mobile 9748 6305  . I will be happy to assess and share with you the possibilities for you in the current market.

Thank you.

Best regards,
Robbie Chen

Hi Robbie - the HDB is not a subsidised flat. No subsidy was received when the BTO was bought. Does this mean I can keep after inheriting and not be forced to sell?
