1) You are currently married thus you and your spouse are considered as a single entity in the eye of the HDB.
2) When you claimed ownership to an HDB flat, your spouse must be an essential occupier if not the owner.
3) You are already aware that an owner and essential occupiers of an HDB flat are not allowed to keep any private property after taking over the title of an HDB flat.
4) The other concern brought up from your info was the HDB flat had way past its MOP. But note that MOP is applicable to the owner and not the flat itself.
5) Therefore once you take over the title of the HDB flat, you are to observe the MOP as well as your spouse.
6) Therefore your idea of keeping the HDB flat while your spouse owns the private property is not workable.
7) If there is no other beneficiary for the HDB flat, you are to dispose of it within 6 months upon receiving the court order.
