Hi Experts,

Would like to ask whether it is common practise now that the property agent gets 50% of the down payment in case the buyer back out after paying the deposit or down payment?

The agent that is working with us now has this clause in the exclusive agreement that he wants us to sign off and we just want to know whether this is the practise now.

This clause is valid in most agreement. However like all service fees and clauses, it is negotiable.

Hi,

Yes this is common practice, however as of all terms & conditions in exclusive arrangements, it can be discussed. If my client is not comfortable with this arrangement, I'm open to removing it. As end of the day, my objective is to help the client meet their objectives and progress with their housing plans.

This has always been a standard practice, as far back as 1997 when i bought my first property.

If a buyer backs out, the 1pct paid to the seller is indeed a WINDFALL. This 'gain' is brought to you by your agent.

if it only fair and professional to share equally with your agent.

Are you looking to sell your property BUT ONLY want to work with an agent who STRIKES off this clause? OR NEGOTIABLE on the amount?

I would be happy to pay any agent who provides me with Good service and brings the buyers.

I hope that sharing 50PCT of the deposit.( with your agent) from a buyer who backed out should not be a consideration when working with any agent. Read More
