A relative rented out a fully paid up 3 room flat for 2 years. The contract expires september 2012. Due to some difficult, she needs to move back and take over the unit. Agent then told her that she can't and that she needs to pay 2 months penalty and on top of that, with a month notice. When we viewed over her contract, it indicates that she only needs a month notice upon completion of 1 year subleting period. So may we get another opinion. Thank you.

Hi sir/madam,

Very simple way to discuss with the agent is to get the agent point out which clause in the tenancy agreement states that your relative cannot give a month's notice to the tenants in order to take over the posession of the property. Examine the clause the agent has pointed out and if the agent cannot do so, pinpoint out the clause that says that your relative is able to do so. However, your relative may need to pay the pro-rated agent fees the tenants had paid to their representing agent.
