Why is this project a Apartment not a condo? What criteria it failed?

An apartment or condominium is classified by its size. If the land area is below 40,000 sq ft, it is an apartment; above this, it is a condo. Hence a development may have full condo facilities, yet will still be classified as an apartment if the land size is below 40,000 sq ft. The reason relates to governance; condos, because of their higher resources are subject to a higher level of governance and scrutiny.
